Intellectual Property Counsel Core Duties and Qualifications

The IP Counsel is a legal professional that is in charge of supervision of trademarks, copyrights, etc., in an organization. It involves knowledge of the laws regarding the IP as well as the capacity in providing analytical data to help the company to decide on measures to protect its inventions and proprietary information.

Roles and Duties

  • Create and bring the strategy for IP rights protection that is in accord with the company’s business goals.
  • Assess threats and possibilities of IP when developing new products that involve new technology.
  • Supervise IP litigation and, where necessary, coordinate with outside counsel.
  • Deal with IP issues, specifically infringement claims, and assist in pre-litigation processes.
  • Offer advice on IP-related contract issues, including licensing and joint venture agreements.
  • Respect IP regulations with regard to jurisdictions that exist for different territories.
  • Perform IP audits to analyze risk exposures and suggest proper measures to minimize the dangers faced by a business.
  • Consult on policy for storage, processing, sharing, and disclosure of sensitive information.
  • Work with R&D, product development, and marketing teams to analyze and identify new IP assets.
  • Arrange seminars and awareness activities on the subject of IPR.
  • Identify and measure IP asset values as well as risks.

Qualifications And Certifications

The following educational qualification and other certifications must be met so as to be in a position to be a intellectual property counsel.

  • Required bachelor’s degree or equivalent in law (LLB) or Juris Doctor (JD).
  • Master’s degree in Intellectual Property, Law (LL.M).
  • Professional certifications of Certified Patent Specialist (CPS), Certified Trademark Specialist (CTS), Registered Patent Attorney (RPA), Certified Intellectual Property Specialist (CIPS), and others are suggested.
