The General Rule: Standard Saudi Labour Law and Saudization Apply to Most Private Sector Employers

Saudi Arabia’s standard private sector employment framework — including Saudization (Nitaqat) obligations — applies to companies registered under the standard Commercial Registration (CR) regime, regardless of whether they operate in a geographic free zone area. Unlike the UAE, where free zone registration creates a distinct legal jurisdiction (DIFC, ADGM, JAFZA) with a separate employment law framework, most Saudi economic zones do not operate under a completely separate employment law system. Standard Saudi Labour Law and MHRSD regulations apply in most cases.

However, Saudi Arabia’s Special Economic Zones established under Vision 2030 — including the SEZ at NEOM, the Ras Al Khair industrial zone, and others — are designed with more distinct regulatory frameworks that may include modified Saudization rules. The specific Saudization obligations for each SEZ must be verified with the relevant zone authority and MHRSD.

NEOM: Saudization and Saudi Labour Law Status

NEOM is a Saudi megaproject city and special economic zone governed by a dedicated regulatory authority. NEOM’s founding vision emphasises Saudi National workforce development as a core principle — Saudi Nationals are intended to comprise a defined percentage of NEOM’s workforce as the project matures. Whether NEOM companies are subject to the standard Nitaqat calculation via Qiwa, or whether NEOM applies its own workforce nationalisation framework, should be verified directly with the NEOM authority and MHRSD. The NEOM regulatory framework is still developing as of 2025, and specific Saudization rules may differ from the standard mainland regime.

King Abdullah Economic City (KAEC): Saudization Framework

King Abdullah Economic City (KAEC) is a special economic zone on the Red Sea coast, developed as a mixed industrial, residential, and commercial city. Companies registered in KAEC are generally subject to Saudi Labour Law and standard MHRSD (Ministry of Human Resources and Social Development, the Saudi federal body responsible for private sector employment regulation and Saudization enforcement) Nitaqat requirements. KAEC does not operate under a separate employment law framework in the same way as UAE financial free zones (DIFC, ADGM). Saudi Special Economic Zones (SEZs): Modified Regulatory Framework

Saudi Arabia announced four Special Economic Zones in 2022 under Vision 2030 — located in Riyadh (King Abdullah Financial District), Jazan, Ras Al Khair, and Cloud Computing (Riyadh). These SEZs offer incentives including tax benefits and streamlined regulations. Whether the SEZ framework includes modified Saudization rules — or operates under the standard Nitaqat regime — varies by zone and is subject to ongoing regulatory development. Companies considering SEZ registration specifically to manage Saudization obligations should verify the current SEZ Nitaqat rules with MHRSD before registration.

Verify before assuming exemption. Unlike UAE free zones, where most zones are clearly exempt from mainland Emiratisation, Saudi Arabia’s SEZ and free zone Saudization rules are less uniformly established. Assuming a Saudization exemption based on zone registration without MHRSD verification creates compliance risk.

HRDF in Saudi Free Zones and SEZs
