End of Service Gratuity
Years 1–5: (Basic ÷ 30) × 21 × years
Years 5+: (Basic ÷ 30) × 30 × years
Cap: 24 months basic salary
Basic salary only. No deduction for resignation under new law.
Annual Leave Entitlement
After 1 year: 30 calendar days/year
6–12 months: 2 days per month
Under 6 months: No entitlement
Calendar days including weekends. Encashment on termination: basic salary only.
Overtime Pay Rate
Hourly rate = Salary ÷ 30 ÷ 8
Standard OT: Hourly × 1.25
Night/Rest day: Hourly × 1.50
Max 2 hours/day OT. Night = 9 PM–4 AM. 6 hrs/day during Ramadan.
Leave Salary Calculation
During service: (Package ÷ 30) × days
On termination: (Basic ÷ 30) × days
Notice pay: (Package ÷ 30) × days
Full package (basic + allowances) during service. Basic only on exit.
Emiratisation Penalty
AED 9,000 per month
× unfilled Emirati positions
= AED 108,000 per year per position

UAE Employment Law Quick Reference 2025

Gratuity LawFederal Decree-Law No. 33 of 2021 — 21 days basic salary/year for first 5 years, 30 days for years beyond 5. Maximum: 2 years basic salary. Full gratuity on resignation after 1 year.
Emiratisation PenaltyAED 108,000 per unfilled Emirati position per year (AED 9,000/month) under Cabinet Resolution No. 31 of 2022. Applies from January 2023.
Probation PeriodMaximum 6 months under Federal Decree-Law No. 33 of 2021. Either party may terminate with 14 days notice. No gratuity during probation if less than 1 year total service.
Annual Leave30 calendar days/year after 1 year. 2 days/month from 6–12 months. Cannot be forfeited — must be paid on termination at basic salary rate.
WPS ComplianceWages must be paid via the Wage Protection System within 15 days of the due date. Non-compliance results in MoHRE fines and potential work permit ban.
UAE Corporate Tax9% corporate tax effective June 2023 for profits above AED 375,000. Free zone qualifying income exempt subject to conditions. Small Business Relief available under AED 3M revenue.
